SystemTuna End User License Agreement (EULA)

This EULA is a legal agreement between you (an individual or entity) and DeinitLabs s.r.o. for the use of SystemTuna (“Software”). By installing, copying, or using the Software, you agree to this EULA.

1) License Grant

• DeinitLabs s.r.o. grants you a non-exclusive, non-sublicensable license to install and use the Software.
• The Software is free to use. A paid license is required for each computer on which you want to use the Software without advertisements.

2) Free Version and Advertisements

• You may use the Software free of charge.
• The free version shows small advertisements for other products of DeinitLabs s.r.o. These advertisements appear only within the Software's own user interface. The Software does not show advertisements for products of other companies.
• A paid SystemTuna license removes these advertisements. A valid license for another DeinitLabs s.r.o. product that DeinitLabs s.r.o. accepts for this purpose, such as NetworkTuna, also removes them.

3) Per-Machine License and Moving Between Machines

• Each license permits use on one computer at a time.
• You may move your license to another machine without restrictions, provided the Software is no longer used on the previous machine.

4) Versioning and Updates

• A purchased license is a one-time fee. It is perpetual, never expires, and has no recurring subscription or renewal fee.
• The license includes all future versions of the Software, including major versions, without an additional license fee.
• This does not require DeinitLabs s.r.o. to create new releases or to provide support or compatibility indefinitely, and it does not limit any updates or remedies required by law.

5) Transfer to Other Parties

• You may not sell, loan, assign, or otherwise transfer your license to another individual or entity without prior written permission from DeinitLabs s.r.o.

6) Ownership

• The Software is licensed, not sold. DeinitLabs s.r.o. retains all rights, title, and interest in and to the Software.

7) Restrictions

• You may not circumvent license enforcement, reverse engineer, decompile, or disassemble the Software except to the extent expressly permitted by applicable law.
• You may not remove or alter trademarks, logos, or notices.

8) Disclaimer of Warranties

• The Software is provided “as is” and “as available” without warranties of any kind, express or implied, to the maximum extent permitted by law.

9) Limitation of Liability

• To the maximum extent permitted by law, DeinitLabs s.r.o. has no responsibility for any harm and shall not be liable for any damages arising from or related to your use of the Software, including without limitation lost profits, data loss, or business interruption.

10) Termination

• This EULA terminates if you materially breach it. Upon termination, you must cease use and uninstall the Software. Sections intended to survive termination shall survive.

11) General

• This EULA is the entire agreement regarding the Software and supersedes prior agreements or communications on this subject. If any provision is unenforceable, the remainder remains in effect. Failure to enforce is not a waiver.
